Terms of Sale and Use

These Terms of Sale and Use ("Terms") govern your purchase and use of digital reports, files, updates, and related materials from Bert Mahoney, doing business as AI Brain Transplant ("AI Brain Transplant," "we," "us," or "our"). By buying, downloading, accessing, or using our products, you agree to these Terms.

Products

We sell independent educational research reports about AI data privacy, provider policies, product distinctions, and related decision factors. Products may include a complete library, a master landscape report, individual provider briefs, translated editions, revised versions, and related digital materials.

No Legal, Privacy, Security, or Compliance Advice

Our products are educational and informational. They are not legal advice, privacy counsel, security advice, compliance advice, audit services, or a substitute for advice from qualified professionals. You are responsible for your own legal, security, procurement, and operational decisions.

Checkout and Payment

Payments are made through Stripe-hosted checkout or another payment processor we identify at checkout. Prices, taxes, currencies, discounts, and available products are shown at checkout. Your purchase is not complete until payment is confirmed.

Digital Delivery

Delivery begins after payment confirmation. Delivery may occur by email, download link, account access, or another method stated at checkout. See our Refund and Delivery Policy for delivery timing, troubleshooting, and refund rules.

License

Unless a product page or written agreement says otherwise, we grant you a limited, non-exclusive, non-transferable license to download and use the purchased reports for your own personal use or internal business evaluation.

You may not resell, redistribute, publish, upload publicly, sublicense, scrape, train models on, create a competing product from, or remove ownership notices from the materials without our prior written permission. You may quote brief excerpts for ordinary internal discussion, commentary, or review, provided you do not reproduce a substantial portion of a report.

Accuracy, Dates, and Provider Changes

AI products, privacy policies, business terms, and documentation can change quickly. Each report should be read in light of its edition date, cited sources, and stated scope. We work to make the reports accurate at publication, but we do not guarantee that every provider policy, product behavior, price, or feature will remain current after publication.

Updates

Update access is governed by our Update Policy. Individual provider briefs include access to revised versions of the purchased brief released within 3 months of purchase. The master landscape report and complete library include access to revised versions of the purchased product released within 6 months of purchase. Update access is not a subscription, does not automatically renew, and does not guarantee that any particular report will change during the update window.

Translations

We may offer translated versions of reports and policies. Unless a product page, checkout page, or written agreement expressly includes a translated edition, your purchase includes the language and files listed at checkout. If there is a conflict between these English Terms and a translation, the English Terms control unless applicable law requires otherwise. See our Translation Policy.

International Customers

We are based in New York, United States, but customers outside the United States may have mandatory local rights that cannot be waived by these Terms. Nothing in these Terms is intended to limit non-waivable rights under applicable consumer, privacy, tax, digital-content, or payment laws. See our International Customers policy.

Refunds

Because our products are digital, refunds are limited after delivery or access begins. See our Refund and Delivery Policy for the complete terms.

Prohibited Use

You may not use the website or products unlawfully, interfere with our systems, attempt unauthorized access, misrepresent your identity, violate intellectual property rights, or use the materials in a way that suggests we endorse your product, service, advice, or conclusions without written permission.

Intellectual Property

The website, reports, design, copy, research structure, graphics, and related materials are owned by us or our licensors and are protected by copyright, trademark, and other laws. No rights are granted except the limited license stated in these Terms.

Disclaimers

To the fullest extent allowed by law, the website and products are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Limitation of Liability

To the fullest extent allowed by law, we will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption. To the fullest extent allowed by law, our total liability for any claim related to a product or purchase will not exceed the amount you paid for the product giving rise to the claim.

Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Subject to any mandatory rights you may have under applicable consumer law, disputes will be handled in the state or federal courts located in New York County, New York, unless the parties agree otherwise in writing. Have counsel review this section before publication, especially if you expect international consumer sales.

Changes to These Terms

We may update these Terms from time to time. The version posted when you purchase governs that purchase unless a later version is required by law or expressly accepted by you.
